(US and Canada) Kenneth Clark, Assistant Director at U.S. Immigrations and Customs Enforcement (ICE), speaks with John Filipek, Senior Manager of Public Sector Inside Federal Sales at SHI, in a video interview about the importance of having a holistic view regarding risk and collective action in the risk scenario.

According to Clark, laws, policies, privacy, security, civil rights and civil liberties, and ethics must be balanced when managing regulatory risk. He says having a clear understanding of risk’s various dimensions is crucial, and an information compliance framework brings the representatives of the multiple disciplines together.

Clark explains that a breach of personally identifiable information is a cybersecurity issue, a privacy issue, a civil rights and liberties issue, an issue of ethical use of data, and a legal and policy issue. He mentions the NIST Special Publication 800-53 as a good example of how to manage regulatory risk, noting that it benefits not only chief information officers, chief data officers, and chief privacy officers but also the legal community. Clark adds that implementing and managing risk needs to be distributed, with full participation and collective action.

How can organizations improve risk management? Clark stresses the need for a holistic view of risk that includes financial, cybersecurity, legal, and critical infrastructure information. He suggests that apart from the experts, all other stakeholders should be aware of the various aspects.

Clark also discusses the need for rules, a deliberative change process, visibility, tying business requirements to using data, standards, and policies, and the importance of good training.

In conclusion, he urges professionals to be part of a data governance community to know what others in the space are doing. They can also use online resources and social media to attain visibility and appreciation for the other disciplines involved.
